Terms of Service

These Terms of Service (“Terms”) govern your use of thekareem.com and the services we provide. By signing up or paying for a subscription, you agree to these Terms.

1. Who we are

thekareem.com is operated by Abdul Kareem (sole proprietor) in Toronto, Ontario, Canada, as part of the The Fame Lee® portfolio. Contact: iammrkareem@gmail.com.

2. The service

For $250 CAD one-time setup + $99 CAD per month, we provide:

  • A custom Next.js website (mobile-first, SEO-friendly)
  • Social media management (Instagram, Facebook, TikTok, YouTube — typically 8–12 posts/month plus 2–4 short-form videos)
  • Google Business Profile + Google Search Console setup
  • Google Analytics (GA4) install with conversion tracking
  • AI-generated image and short-form video assets
  • Email autoresponders and booking-flow automations
  • Monthly performance report
  • On-call updates within 24 hours, Monday to Friday

3. What's NOT included

The monthly subscription does not include: paid ad spend (you fund your own Google/Meta ads), photography or videography shoots, custom illustration, full brand identity packages, e-commerce backend builds beyond Stripe checkout, or major redesigns. We can quote these as separate flat-fee projects.

4. Payment terms

  • The $250 setup fee is charged once when you sign up.
  • The $99/month subscription recurs every 30 days (or the equivalent monthly anniversary) until cancelled.
  • All payments are in Canadian Dollars (CAD) and processed by Stripe. We do not see your card number.
  • Failed payments will be retried for up to 7 days. If still unpaid, the subscription pauses and the website may be temporarily taken offline.
  • Applicable Canadian taxes (GST/HST/PST) are added at checkout where required.

5. Cancellation

You can cancel at any time, for any reason. Cancellation takes effect at the end of the current billing month — you keep access until that date. To cancel, email iammrkareem@gmail.com from the email address associated with your account.

6. Refunds

See our Refund Policy for the full details. In short: setup fee is refundable only before work begins; monthly fees are non-refundable for the current month but you can cancel future months at any time.

7. Ownership & transfer

  • You own your domain. If you brought your own domain, it stays yours. If we registered one for you, we transfer it on request.
  • You own your content. Copy, photos, and brand assets you provide stay yours.
  • You own your website code. On cancellation, we'll export the Next.js codebase and database (if any) and hand it over. We may charge a one-time export/handover fee of $250 CAD.
  • We retain limited rights: We may showcase your website (publicly visible URL + screenshot) in our portfolio unless you opt out in writing.

8. Service-level expectations

We're a founder-led studio, not a 24/7 call centre. Realistic expectations:

  • Response time: within 1 business day, Monday–Friday, Eastern Time.
  • Small updates (copy change, new section, swap an image): typically within 24–72 business hours.
  • Larger updates (new page, restructure): scoped and quoted separately.
  • Uptime: we host on infrastructure that targets 99.5% monthly uptime. We don't guarantee it.

9. Your responsibilities

  • Provide accurate business info, logo, photos, and content in a timely manner.
  • Don't use our services for illegal, deceptive, hateful, or harmful content. We reserve the right to refuse or terminate service for any reason, with a pro-rated refund of unused months.
  • Make sure you have the right to use content you give us (no stolen photos, no unlicensed music, etc.).

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of these Terms is limited to the amount you have paid us in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages (lost profits, lost data, lost opportunities). This applies even if we were advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold us harmless against any third-party claims arising from content you provide or instruct us to publish (e.g., infringement, defamation, misleading claims).

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute will be resolved exclusively in the courts located in Toronto, Ontario.

13. Changes to these Terms

We may update these Terms periodically. Material changes will be emailed to active subscribers at least 30 days before they take effect. Continued use of the service after that constitutes acceptance.
